Prescribed By
FAR 4.2105(c) — Required in solicitations; this is the SAM-level annual representation.
Flow-down to Subcontracts

Not flowed down (annual offeror representation).

What this clause requires

  • 1Annual representation in SAM whether the entity provides or uses covered telecom equipment/services.
  • 2Reasonable inquiry into supply chain and IT inventory at the time of representation.
  • 3Update representation any time material facts change — do not wait for the annual cycle.

When this clause applies

Every entity required to register in SAM (i.e., everyone bidding on Federal work). Updated as part of the annual SAM renewal.

Common pitfalls

!Letting the rep go stale between annual updates — material facts change (new IT assets, M&A, leases).
!Misinterpreting 'reasonable inquiry' as no-affirmative-knowledge — the standard is active diligence.

Proposal-team checklist

  • Tie SAM annual renewal to a documented supply-chain inventory and IT asset review.
  • Re-run the inquiry whenever there is an M&A event or major facilities change.
